These Terms apply to the Website www.movocapital.ca (the “Website”) which is owned and operated by 9482-9595 Quebec Inc., doing business as Movo Capital. Movo Capital is in the business of providing, tyhrough its partners, small business loans, lines of credit, merchant cash advances, business loans, equipment financing and related business credit services.

Accepting the Terms.

Use of the Website is offered to you conditional on your acceptance without modification of the terms, conditions, and notices contained herein. By submitting an application for credit to Movo Capital, you signify that you have read, understand and agree to be bound by these terms and conditions for any and all applications for credit to Movo Capital. You may not use the service if you are under 18 years of age. You represent that you have the capacity to bind the company or entity applying for credit, on behalf of such company or entity. Your use of the Website constitutes your agreement to all such terms, conditions, and notices. If you are in disagreement with the present conditions of use, your sole recourse consists in ceasing using the Website.

Modifications of the Terms.

Movo Capital may make changes to this Agreement from time to time. If we do this, the date at the top of this page indicates when the latest revisions were made. Your continued use of the Service or the Website will constitute acceptance of such revisions.

Processing of Your Application.

Movo Capital is solely a referral service which pairs businesses searching for credit products with providers of credit products. We do not arrange for or facilitate credit. When you submit an application to Movo Capital (the "Application") we work together with service providers to process your Application. We will release some or all of the information in your Application to these service providers in order to locate an appropriate credit provider for you. By submitting an Application to Movo Capital, you certify that all information which you provide in the Application is true and complete and you authorize Movo Capital or our partners to; contact you in order to obtain credit information concerning your Application; communicate with you in-person, by telephone, mail, email, text; provide reports to you on the status of your Application; transmit your Application to one or more organizations for the purpose of facilitating your Application.

Third-Party Sites or Content.

The Website or other materials sent to you under the Service may contain links to other Websites (“Third Party Sites”), as well as content from third parties. Movo Capital is not responsible for such Third Party Sites or content from third parties, including without limitation accuracy, reliability, offensiveness, or appropriateness. If you decide to leave the Website and access Third Party Sites or third-party content, this Agreement and Movo Capital policies no longer apply. In addition, if any such link is to another capital provider or lender, Movo Capital acts solely as a referrer and does not guarantee or underwrite the products or services, including credit products, provided by such capital provider or lender. You will be deemed a customer of that capital provider or lender with respect to any products or services provided by such capital provider or lender. Movo Capital has no role in, nor any liability for any decision made or product or service provided by such other capital provider or lender.

Intellectual Property.

All content included on this Website, such as text, graphics, logos, images, audio clips, and software, is the property of Movo Capital or its content suppliers and is protected by Canadian and international copyright laws. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this Website including code and software without prior written permission from Movo Capital.

Limitation of Liability.

Movo Capital will not be liable for any damages of any kind arising from the use of this Website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages. You hereby agree to defend, indemnify, and hold harmless Movo Capital, its affiliates, third-party licensors, their respective directors, officers, employees, and agents and their successors and assigns from and against any liability, loss, claim, and expense, including legal fees and disbursements on a solicitor-client basis related to any violation of the Terms, the Privacy Policy or your use of the Website, or any information on the Website.

General.

The Terms will be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein without regard to conflict of law principles, and you hereby consent and submit to the jurisdiction of the courts of the Province of Quebec in any action or proceeding instituted under or related to the Terms. To the extent that any portion of the Terms shall be determined to be unenforceable by a court of the Province of Quebec, such portion will be modified by such court to the extent necessary to cause such portion to be enforceable, and the remaining Terms will remain in full force and effect. Any waiver of any provisions contained in the Terms shall not be deemed to be a waiver of any other right, term, or provision of the Terms. The Terms constitute the entire agreement between you and Movo Capital with respect to the Website and supersede all previous written or oral agreements between you and Movo Capital with respect to the Website.
